Terms of Service

These terms govern your use of Surgedeck, a software tool for building, tracking and optimising affiliate marketing funnels. By creating an account you agree to them.

1. What Surgedeck is

Surgedeck is software. We give you funnel templates, link tracking, reporting and email tooling. We do not sell affiliate offers, we are not an affiliate network, and we do not pay commissions.

2. No earnings guarantee

Surgedeck makes no promise, guarantee or projection of income. Any figures shown in the product are your own data or illustrative examples. Results depend entirely on the offers you promote, the traffic you buy, your own skill and factors outside our control. Affiliate marketing can and often does lose money. You are solely responsible for your ad spend and your business decisions.

3. Your account

• You must be at least 18 and provide accurate details.
• You are responsible for keeping your password and connected credentials secure.
• One account per person unless we agree otherwise in writing.

4. Subscriptions and billing

• Plans are billed monthly in advance and renew automatically until you cancel.
• If you start on the $7 seven-day trial, the $7 is charged immediately and your plan's normal monthly price is charged on day 8 and every month after that unless you cancel first.
• Prices are shown in US dollars. Applicable sales tax, VAT or GST is added at checkout.
• You can cancel at any time from Plan & Billing. Cancellation stops future charges; access continues until the end of the period you have already paid for.
• Plan changes are pro-rated — you pay only the difference for the remainder of the current period.
• Failed payments may be retried. Persistent non-payment ends your subscription.

5. Traffic packages

Traffic packages bought inside Surgedeck are separate one-off purchases, not part of your subscription. We deliver the number of clicks stated in the package. We do not guarantee opt-ins, sales or profit from any traffic order.

6. Acceptable use

You agree not to use Surgedeck to:

• Send unsolicited bulk email or violate CAN-SPAM, GDPR or your autoresponder's terms.
• Promote illegal products, adult content, or make false or misleading income claims to your own leads.
• Send bot, incentivised or otherwise fraudulent traffic to offers.
• Scrape, resell or reverse-engineer the platform.

We may suspend or terminate accounts that breach this section, without refund of the current period.

7. Third-party services

Surgedeck connects to services you choose, such as AWeber, GetResponse and affiliate networks. Your use of those services is governed by their terms, and we are not responsible for their availability or decisions.

8. Availability and liability

The service is provided "as is". We aim for high availability but do not guarantee uninterrupted service. To the maximum extent permitted by law, our total liability to you is limited to the amount you paid us in the twelve months before the claim. We are not liable for lost profits, lost commissions or ad spend.

9. Changes

We may update these terms or our pricing. Material changes are notified by email or in-app at least 14 days before they apply to your renewal. Continuing to use Surgedeck after that means you accept the change.
